The Impact of Koontz: How the Recent U.S. Supreme Court Takings Ruling Will Impact You

Please join the Puget Sound Lawyers Chapter (Seattle) of The Federalist Society for a lively panel discussion on the recent United States Supreme Court ruling that significantly expanded the scope of the Takings Clause of the Fifth Amendment.

The ruling in Koontz v. St. Johns River Water Management District, 570 U.S. __, No. 11-1447, slip op. (June 25, 2013) marks the first time the Court has ruled that the rigorous “nexus” and “rough proportionality” requirements, previously only applicable where a land owner is forced to transfer a property right to the government also applies to a government demand that an applicant pay money or spend money before the government would grant a land use permit.

Panelists will include:
  • Brian T. Hodges, Managing Attorney, Northwest Center, Pacific Legal Foundation
  • Richard L. Settle, Land Use Attorney, Foster Pepper PLLC
  • Roger Wynne, Assistant City Attorney - Land Use Section, Seattle City Attorney's Office
  • Moderated by: Joel B. Ard, President, Puget Sound Lawyers Chapter; Member, Foster Pepper PLLC
